Terms and Conditions for New Clean Facility Services Pty Ltd:
Introduction
1.1. These Terms and Conditions ("Terms") govern the provision of commercial cleaning services ("Services") by New Clean Facility Services Pty Ltd ("New Clean," "we," "us," or "our") to you, the customer ("Customer," "you," or "your").
1.2. By engaging our Services, you acknowledge and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.
Services
2.1. We will provide the Services to you as set out in the agreement between us.
2.2. We will use reasonable care and skill in the provision of the Services.
2.3. You agree to provide us with access to your premises and any other information reasonably necessary for us to provide the Services.
Fees and Payment
3.1. The fees for the Services will be as set out in the agreement between us.
3.2. You agree to pay our fees in accordance with the payment terms set out in the agreement between us.
3.3. If you fail to pay our fees in accordance with the payment terms, we may suspend or terminate the Services.
Cancellation
4.1. You may cancel the Services by giving us written notice at least 24 hours prior to the scheduled cleaning.
4.2. If you cancel the Services within 24 hours of the scheduled cleaning, we reserve the right to charge you the full fee for the cancelled Services.
Liability
5.1. We will not be liable for any loss or damage that is not foreseeable or which is beyond our reasonable control.
5.2. Our liability to you for any loss or damage arising out of or in connection with the Services will be limited to the total fees paid by you for the Services.
5.3. Nothing in these Terms will limit or exclude our liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
Termination
6.1. Either party may terminate the agreement between us by giving 30 days' written notice to the other party.
6.2. We may terminate the agreement between us immediately if you breach any of these Terms.
6.3. Termination of the agreement between us will not affect any rights or obligations that have accrued up to the date of termination.
General
7.1. These Terms constitute the entire agreement between us and supersede all prior agreements and understandings.
7.2. These Terms may only be varied by us in writing.
7.3. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
7.4. These Terms will be governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising out of or in connection with these Terms will be subject to the non-exclusive jurisdiction of the courts of Victoria.
